Can you get a speeding ticket when driving below the posted speed limit?
YES YOU CAN!
Vehicle and Traffic Law 1180a says a person can get a speeding ticket for driving a speed that is unreasonable or imprudent under the circumstances. Say you are driving 45 mph in a 55 mph zone — through a blizzard — and there is snow or ice on the road. A police officer may issue you a ticket if he thinks you were driving at an imprudent or unreasonable speed under the conditions. This ticket is a 3 point moving violation.
Vehicle and Traffic Law 1181 says you can get a ticket for driving too slowly that you impede traffic. This is also a ticketable offense.
The good news is that I’ve had many of these tickets thrown out. In any event, please be safe!
